Hello my name is Sarah Dunphy.
I am writing this as I would like people to be aware how other countries including those in the European Union treat our deceased when they die on there territory, even though they are British citizens. I have a petition on this site I would like you to sign if you are in agreement, this will then be taken to London to be read by Mr Blair.

I have created http://www.frans-law.co.uk so others who have or are going through the same can contact me and I can help them. I feel it is our right that when British citizens on holiday pass away in another country, they respect the laws surrounding organ retention in the UK. Our law states you are only allowed to have your organs retained with consent of next of kin, and then every body knows where they stand. And I would also like to state that I am not against organ donation and neither was my mum, as long as there is consent that way you have a choice.

My mum Fran Dunphy (49), Carl Reeves, my fianc� (22), my daughter Louise (13), my son Liam (10) and I (29) went on holiday to Spain Costa Dorada in Salou on the 5th may 2004. My dad Brent Dunphy who my mum has been happily married to for 35 years didn't want to come as he has a fear of flying. We were out all day and had a really great day, but about 3 o'clock my mum complained of pains in her left arm but said they were not severe enough to go to hospital, my mum had been to the hospital in England 2 days prior to our holiday as she had pains in her legs and my dad wanted to be certain it was safe to fly. She had a veinogram on her legs and they gave her the all clear said she was really healthy, so we went back to the hotel called the Cala font. My daughter was sharing a room with my mum and us three were in the other room as the rooms weren't big enough for all of us.

Mum had a lay down and the kids were playing in the pool, at 5.50 I got in the shower ready for the night ahead I was talking to my mum though the bathroom cupboard then she cried out, I ran in her room to find her face down in a pool of blood gasping for air. I pulled her by the legs and turned her over she had stopped breathing, I screamed for Carl to call an ambulance. I checked for a pulse but there wasn't one so I then began CPR, I got a pulse but still my mum wasn't breathing and was unconscious, her pulse went again and I repeated CPR but there was a lot of blood coming from my mums mouth in to mine, my first thought was she is having a embolism of the lung which my Nan died of at the age of 47, this went on and then my mum died in my arms. The doctors arrived but wouldn't let any one in the room, they were in there for ages.

There were two reps to help me to try and calm down, my fianc� Carl was brilliant, at 7.50 the doctor came in and told me there was nothing they could do my world collapsed I had to get back to England to tell my dad and the rest of the family what had happened, we were all as you can imagine, absolutely devastated we had lost our best friend.

A few days after we returned I got in contact with AXA insurance to get my mum repatriated back from Spain, this took 9 days. When my mum was brought back from Spain the paperwork came to, it stated that on the 8th of may they had embalmed her body and on the 12th they carried out the autopsy but this has been done the wrong way round, HOW can you do an autopsy on a body that has already been embalmed, embalming washes out the blood from the body so then you cant tell if there was a blood clot. I felt something wasn't right and so did my dad, so we decided we wanted a second autopsy done.

Peter Daultry, an English coroner, performed the second autopsy. He rang me to tell me the Spanish had removed my mum's heart and kidney with out my consent, I was very shocked. I couldn't handle another blow, I contacted the Spanish embassy and they said it was there law to do this and they could keep tissues and organs for biopsy. I was angry as now I couldn't cremate my mum as a whole person and felt this was a disgusting way to treat people and there was no cause of death which is even worse as we will never know now what my mum died of.

I have fought and fought to get my Mums organs back so I can have them cremated and put with the rest of her body where they belong, my Dad and I are absolutely shattered. We have appeared on the BBC1 news, the Sunday People paper and the Herald because we want retention of organs with out consent stopped. WHY should we and others have to go through this, its not right, I think that the doctors took my mums organs for donation in the hotel room, as does my dad, they were in there too long and were acting very shady. I am going to campaign non-stop to get this barbaric law changed, just the thought of someone else having to go through this makes me feel sick, there is no need for it, one phone call is all it would of taken to let me know they needed to keep the organs back for a while for study, 2 funerals my dad and I had to change because of delay by the Spanish, my mums death certificate states Cardiac Arrhythmia (irregular heart beat), yeah right, so where did all the blood come from?

We'd also ask you spread the word on this to your friends and family, and help bring this issue to the public eye.

Sorry about your Mum Sarah, I too stayed at the Cala Font last year, but on the 20th May.

I've signed the petition, good luck with it and be sure to keep us updated :)
