We are in the process of trying to transfer our time share deeds to this company.? (DWVC) Has anyone successfully managed this and is now not paying management/mantainance fees. Any info would help please.

Scoggy - if you were pulled in by a tout you have the right to cancel under Spanish doorstep selling regulations AND they should have told you. Hang on to your money. If contacted say that you have cancelled - nothing else. Don't speak to them on the phone - if they have anything to say make them keep it all in writing. You will probably receive threatening letters. Keep them, but ignore them. Please come back with details of what they do and say.

HELP! I too was scammed by the scratch card technique back in Fuerteventura in Jul 07. i had my twin boys who were well looked after at the DWVC HO and we were duped by the cashback promise. I entered into a 3 1/2yr deal at a cost of 3500 pounds. I paid deposit of 1000pound on mastercard and the balance is due this month. I have started to have sleepness nights as i do not want to pay after reading all these shocking experiences.
I asked at the time about a 'cooling off' period they said there wasn't one.
Do you think i have a leg to stand on as it has been 6 months- but i buried my head in sand hoping they would go away!

Scammed07 - much of the above applies. If you were pulled in by a scratchcard tout or similar they were obliged to give you a written notice of your right to cancel. If they didn't they have broken the law. If you were told that you WOULD get ALL or most of your money back through cashback and that is one of the major reasons why you signed then you have every right to cancel due to misrepresentation. Start the procedure to get your deposit back from your cc company. State that you are claiming under the Consumer Credit Act 1974 due to gross misrepresentation by the seller and an unlawful failure to set out your rights of cancellation. Be prepared for resistance - come back here when you meet it.

Scammed07, they won't go away and will undoubtedly becoe more aggressive and threatening in their correspondence. Do Not show any weakness, and reclaim your deposit as described by Fred above. This is very important as failure to reclaim may be construed as acceptance of their terms. Notify everyone you can, including the authorities mentioned in these forums such as the TCA, OFT, and even your MP. Don't rest on your laurels doing nothing!

Sandieg - if you look at the post you will see that new boy 3 posted three years ago.
It is extremely hard to mount a joint action. Any joint approach is probably better done through the press. If you have a problem you may well find the answer by reading the thread, otherwise - ask and somebody will do their best to help.

Good news, ILG have agreed to refund the full deposit and cancell the contract.
The money is now safely back in it's rightfull place, my fathers savings account, and he has a parcel to collect which we imagine is the original Time share deeds.
We have followed the advise on this forum in the main, however, my father did speak to ILG when they phoned and maintained a friendly relationship with the lady that he was speaking to. We a couple of letters to ILG, and to DWVC, contacted the Timeshare Assosciation (who helped keep the old chin up), European consumers association who came back for more info last week (a little too late, but they were about to contact the company for us, so would recomend getting in touch with them) and every other official body that is mentioned on this forum.
Keep at it, appear to be reasonable at all times (this will help if you go to small claims court, you have to be seen as having tried to sort the problem out amicably)... The right result is out there.
