If you are going for St Frances Marketing Limited t/a Buena Viva I don't see a problem. You would all be taking action against St F on the same grounds, so no need to split up. Action against finance houses/ cc companies would be a separate issue. A verdict in your favour against St F would make it impossible for the cc cos &c to deny that there was a problem and all of you would have access to copies of that info to make use of, so it would not matter which cc co or finance house was involved in individual cases.

Hi Jint,

The agreement is activated by the finance company and BV - after the 14 day cool off period. At that stage the money is then released to BV's Trust fund (Hutchinson's) . So even if you paid via GE , Barclays Partner Finance,or whoever, it won't make any difference because you are already liable for the debt the moment the funds have been released.

Although you do not need to make any payments until October, you are already paying interest from the date the agreement was activated.

Like Fred2 said, it will be easier to go for St.Frances first with your joint action and then go for the finance companies.

The letter we had back from GE said they had sent a copy of our letter to St Francis for their comments etc and that they had to send a reply to us with a copy to GE, we havent received anything back yet.But I agree then that we should all get together somehow over this.

Hi JINT,

Keep putting the pressure on both GE and BV.
Finance companies are notorious for giving people the runaround and will put lots of obstacles in the way. They are obviously aware that you may attempt to take action under the CCA1974.

If we are meeting up could we do it soon as I have lots of commitments abroad and as I have been too ashamed to tell anyone what I've got myself into, I can't get out of them. Maybe we could meet up in London as it's central?

We have already said in our letter to GE about holding them equally responsible under that Act doesnt seem to make any difference. But we will perservere, I think they know we are right!!!
Ishrat if your from Bristol and we are from Glos how about meeting half way, London is rather too far for us. It would be better sooner like you say because Im waiting to go into hospital for a op.

I think arranging a group conference about this is a very positive step forward and my wife and I would be up for it - definately. We live in south Somerset, nr Yeovil. Our email: dramus@tiscali.co.uk for ease of communication but will obviously note developments on this forum.
A colleague of mine should have attended a 'presentation' at Exeter this weekend but I had warned him and decided not to attend. Totally identical to our invitation but this time issued by Coastal Marketing - Paignton rather than Oasis - Paignton. So that's one customer less - yipee!!! (sorry).

When you hav established who is in the group - and that there are no cuckoos in the nest - you could consider opening an e-mail account to which you all had the password (and the name of the account was unknown to others) to use as a drop-box for information. You would all be able to access it and it would avoid the need to pass everyting around. As it would not be a personal account you could give a solicitor access if needed.

To clarify my last rushed contribution, we think that asking a solicitor to act on behalf of a group of us is the best way forward if we are to stand any chance of being successful. Strength in numbers and all that. Count us in!

Hi we have been following the thread and notice there is two groups involved in the same process. Those who successfully cancelled within the cooling off period (fortunately ourselves) and those who too far down the line and should be grouping together to see a solictor. I have sent a letter to CET which I am sending to BPF as I was given an option to respond to the complaint I had made. The main context is why are they still financially supporting a company that is obviously mis-leading their customers into buying a service which does not exist. I will update when I receive a reply.
