How do I cancel membership with Diamond Resorts

I am writing on behalf of my Parents, Plain and simple, They just need to get out of the arrangement.. They feel that they were wrongly sold this product in the first place, but I know that won't wash as they've had and used the product for 3years, they paid �6k and paid onward and upward maintenance costs of �300, 500 and 800 respectivly..

Is there a way to just cancel? the �6000 is not an issue, they just have no use for this and the worry about the ongoing maintance fee I believe is affecting their health, as this appears to be with them for life I do not want them carrying this burden into old age!

Any help appreciated

Have they got points or weeks?

They should be extremely wary if contacted by anyone who says that they have a buyer - and I would not recommend responding to an ETOO advertisement should they see one.

- and please don't post all over. It is far better to keep all answers in one place.

Thanks Fred for the reply I will keep my correspondence to this one thread.

with regards to timesharetalk I thought by their speedy response they looked a little suspect..

Yes they are points, and their friends have already fell for the "we'll sell the points for you" costing them a few hundred pounds.

What I am struggling with most is that my parents have signed up for something that they will be taking beyond the grave, for what effectively has no equity or value and is certainly no investment and has the potential to be passed down ?!? not sure where I gave this consent. However, I know what will happen as my parents get older they will have less money, the �800 will become a lot more, they will be older and I am really concerned what affect this will have, as mentioned it is already bothering them now.

The response on TST was not at all suspect. The points will continue to produce holidays. Had you considered letting family members use them, making a contribution to the maintenance? They can be sold, at a fraction of the purchase price, to existing members. I think that there is a free "small ads" section on TST. "Ultimately" - should they not be disposed of - no-one can be compelled to take a bequest.

so there is no way to terminate the contract? because even with all the points sold I think there is still an ongoing membership? or is it a case of selling the points to a balance of zero - via ebay or something similar and then canceling the membership as if there are no points then the membership becomes invalid? providing all fees are upto date from previous years.

or to put it another way my parents are only legally responsible to pay the maintenance and membership if they have points - no points = no maintenance and ability to drop they're membership (if they have no intention of buying more points)

It is the holding of the points which creates the membership and gives rise to the charge, The charge is required to service the holiday accommodation and the right to occupy that accommodation depends on the holding of points. No points - no charge and no membership.

No problem. Here is an extract from a recent letter put out by Diamond on 19 May 2008

Quote" Notwithstanding these payment options Diamond Resorts Management, Ltd. recognizes that there may be
Members who for various reasons, including retirement, illness, loss of income, etc., may find the extra cost of
this supplemental billing to be a burden that they can no longer afford to absorb. Accordingly, the
Management Company has agreed with Diamond Resorts (Europe) Ltd, that any Member who may wish to
surrender his or her membership may do so at no cost to them, as would normally occur for unpaid
management fees, and that Diamond Resorts (Europe) Ltd will assume responsibility for the outstanding and
future management fees.
Should you choose to surrender your membership at no cost to you, simply inform Diamond Resorts
Management, Ltd. by contacting them at owneroperations@diamondresorts.com or 0845 359 0007 or Owner
Operations, Citrus House, Caton Road, Lancaster, LA1 3UA within the next 30 days. Upon receipt, your
membership shall terminate and you will be released from all liabilities owed to Diamond Resorts Management
Ltd. including outstanding and future management fees.""
