Hi, Today I received a response to my email to Gail Hughes. She left a message on my ansaphone, a message on my mobile and an email. She urgently wants to speak to me and has asked that I ring her tomorrow. This is in response to my email where I stated that KPTA is all a con and demanding my parents' money back.

This is what her email said and I wonder if anyone has any views on this please:

"In regards to various gossip websites we hope that the following information will help allay any concerns you might have.

Internet Service Providers or ISP for short are overseen by an internet governing body. On normal websites no disclaimer would need to be displayed, however by virtue of the fact that the ISP has forced theses sites to display disclaimers means the websites´ contents are questionable. If they did not agree to post this disclaimer on its FRONT page it would have been unable to have its web pages hosted by that service provider.

Posting false and defamatory information online also amounts to libel, not just on a website but also in the context of a discussion on a message board. Libel is defined as a false publication, as in writing, print, signs, or pictures, which damages a person's reputation or personal business. The internet has become a very popular place to flame people or to write posts for others to read that are meant to insult and provoke a person or business.

Flame posters are now being sued by people and companies for libel.
¨Cyber libel¨ is a catchphrase for defamation that takes place through the Internet, either on message boards, email, blogs, chat rooms, personal websites, or other published articles.

Under cyber libel laws, we are taking steps to have all the information posted about our company removed. Our lawyers are seeking to have the information about us removed under Section 19 (ii). We are not the only company which has had to take these steps and we will be as equally successful in having this information removed as the others were. Under Electronic Commerce (EC Directive) Regulations 2002, an Internet Service Provider or ISP cannot escape liability, once it has and been made aware that libellous material is appearing on a web page it is hosting.

We will also be seeking further information under Section 6 (1) a to f including 1, 2 & 3 and should this not be forthcoming seek to have the information about us removed under Section 19 (ii). Unfortunately; these things take time; until then we will have to be patient and try to allay any concerns that people like yourselves might have, having seen our company posted on this site.

We have been informed that the Spanish authorities have been made fully aware of these websites, their related companies and the persons running them and we understand they are looking into their activities at a very high level.

To conclude, these websites are gossip websites where people may post information therein, relating to whatever topic they like to comment on within the timeshare sector. It is also a pure “ghost” website, meaning you are unable to verbally contact anyone to verify the information posted therein. Most other attempts to contact these
persons are made possible by Apto de Correos or Post Office Box
numbers only, depending where the site is being hosted.

All of the above equally applies to gossip websites around the world who host message boards and forums, which seek to besmirch the good name our company has built up over the past 5 years. Furthermore we believe that a large proportion of the malicious information being posted about us is from the large number of companies we are currently taking action against.
