I have seen on another forum that the House of Lords is holding an inquiry related to the proposed new Timeshare Directive.

The inquiry is interviewing various people but is also calling for people to write in with evidence. By that they mean hard relevant evidence (not just a rant) and the posters on this forum seem to have as much first-hand experience about Holiday Clubs as anyone.

The consultation period runs until 14th September and then you have lost your chance to make a difference.

and there are links to the rules for the submission of evidence which must be read before sending anything, and an e-mail address.

I would like to say Thank you for your information and advice.
My husband and I fell for the ILG Fuengirola DWVC holiday club scam/con in June, Our story and experiences follow similar lines to others on this website. We followed the threads from this website closely and did what was suggested.
The CC company has now clawed back the deposit we paid.
Now a 2nd ILG letter has arrived from their legal department threatening legal action if we do not pay the monies owed to them.
We will follow the advice from this site, hopefully no more letters will follow. However, we do not know.
In the early stages I contacted Sandy Gray was from TCA and his advice was invaluable, like yours- both you and he alleviated many of our worries.

I paid a deposit for a holiday membership agreement which they wont cancel so I am trying to get my money back through the credit card company.If I am not succesful were would I stand if I sued the person who signed the agreement on behalf of the company through the small claims court I have names and the address of the person in Tenerife or is it just these people who can take action when they want money from us?I dont know has anyone got thoughts on this or is this not the done thing.

IT IS NOT AN ADVICE THREAD.

Look for the thread with the name of the company that you dealt with or got signed up to. POST THERE. Tell us the name of the company and what the deal was. Tell us why you want out.

Dear Fred 2.
We have been following the threads about holiday clubs as we too foolishly became involved recently. Your contribution has been invaluable-thankyou.
With reference to the new Time share Directive I have tried to contact Barry Werner, Clerk to European Union Sub committee G directly. Unfortunately he is on holiday until the 10th Sept. I contacted the Secretary, Melanie Moore. She is also on summer recess but will be checking her mail during August. I wanted some clearer guidelines about the type of evidence they were looking for. If I get a response before the 14th Sept. I'll post it here.
I've also drafted a letter outlining our experience to send to all the consumer groups, both statutory and voluntary and local M.P.
It does sound like things are hotting up for D.W.V.C. and the more everyone formalises their complaint the greater the pressure on D.W.V.C.
I suspect there are many people who, like us have been following the threads but haven't contributed.

Brainstorm - if you follow the link in my original post and look down it to
"Replacement of the EU's Timeshare Directive
The Call for Evidence was issued on 5 July and the closing date for submissions is 14 September."
you will find a link which downloads a Word document setting out what they are after - this also says that they will consider anything else which appears to be relevant.

- and, as you say, things do seem to be hotting up for DWVC, and not before time.

Just been reading your threads re Timelinx,dwvc.
We are at this moment away at Fuerteventura and have just been caught with all the things that you have written about.
We have paid a deposit with the balance due upon our return.
They say there is no cooling of period, is this correct? I don�t intend to pay anymore money and will tell them I�ve changed my mind.
Is this contract binding as it is? I�m sure they will threaten legal action but I know under UK law there is a change of mind time, not to sure if it applys out here.
Wish i had a chance to read all the threads first, Keep writing,will tryto log in later to see if anyone can help.

Robbo - this is not the right thread. This is only about the Timeshare Directive. Would you re-post on the DWVC one so that everyone will see it. There is no reason why you should go through with the thing. I hope that you paid by credit card.

After learning, from this forum, about the Lords Select Committee I also e.mailed a submission to the addresses named on the website. I received auto responses telling me they were out of the office until 1st October, so I then mailed the Lords Clerk and received a positive response as follows:- "Thank you for your submissions. Parliament is in recess until 8 October. Melanie Moore and Barry Werner will see your submissions when they are next in the office."
Earlier today, I also contacted my MP using the website http://www.writetothem.com and have received an even more positive response as follows:- "I was not aware of the Lords Select Committee investigation and I thank you for bringing it to my attention. Now that I am in receipt of this e-mail and your previous correspondence, I shall also use my headed paper to present your concerns to the Chairman of this Select Committee.
Furthermore, if at a later date, you feel that you have further
information/evidence that warrants the Committee's attention please do
not hesitate to forward it to me."
I had already contacted my MP in writing about this continuing scam, and the lack of initiative by the O.F.T, in dealing with it, and sent him various relative documents including the threatening letters from Incentive Leisure, and the Mirror group website details of their investigations.
May I suggest every 'victim' contacts their MP, and maybe also their Euro-MP using the 'write to them. web-site which I've detailed above.
