We have just returned from exeter having been in a very long meeting with Travelexe.
We were first contacted by TSO13 and told that travelexe would take our timeshare at a good price.
After soon as we were taken into the meeting area there was a "timeshare sales" feel about it.
After about 20 minutes of idle chit chat we were introduced to a rep who started explaining everything. She explained that apart from the obvious methods of selling timeshare (i.e. resale companies, ebay and in the papers) which don't work. The only other method is 'CASHBACK'
She then explained the principles of cashback.
At this point it becomes apparant that to get your cashback you need to buy into 'Club Class Concierge' - see website for details.
To sum up -
Our Timeshare was valued at 5500 (amazing!)
The cost to join Club Class Concierge in 10995
You pay 10995 and after 3 years get cashback on the whole lot i.e. 16,495.
The cashback is with a company called 'Cashback Europe' and they have a full website.
We spent along time thinking about this as the cash back arrangement is nothing to do with travelexe. We were aware that there may be a chance of loosing more money but eventually signed up.
I have paid nothing as yet and intend to find out as much as possible about all of the companies involved during the 14 day 'Cooling off period'.
I would like to hear from anyone with more info on this ASAP

Baggers - have you READ this thread?
One more time -
YOU DO NOT GET ALL YOUR MONEY BACK THROUGH CASHBACK.
The cashback contract promises to pay no more than 10%, may be less, of face value and it does this ONLY if you jump through all the contractual hoops without making a mistake - if you don't you get zilch.
In addition you really do not want a membership in Club Class.

You are very fortunate not to have paid anything yet.

PLEASE NOTE:
From what I can see MOST of these 'HOLIDAY CLUB' companies are on the March 2008 'Timeshare' Blacklist!
They have exploited a loophole regarding the sale of 'Timeshare'. In otherwords they call themselves 'Holiday Clubs' now!
They are using Barclays Partner Finance to cover up the fact that they really use Clydesdale Financial Services for your credit agreements.
Clydesdale Financial Services are on the 'Timeshare Blacklist' too!
(If you think your credit agreement might have been switched , it would state information relating to the Timeshare Act 1992.
'This agreement is a timeshare agreement for the purpose of the Timeshare Act 1992.'
WHY WOULD YOUR AGREEMENT SAY THIS IF IT IS A HOLIDAY CLUB AND NOT A TIMESHARE?
Why would your finance company authorise this if they are a BLACKLISTED TIMESHARE company?
Therefore it is obviously a 'Timeshare' product! AND they are not allowed to sell Timeshare if they are blacklisted!
Our 'switched' credit agreement was doctored. The logo on the top right hand side was covered!
It's all a big scam!
All of the relevent authorites (OFT,Trading Standards,Consumer Direct,FSA etc); that you ask to investigate this, are not going far enough in their investigations.(They do not go outside their little box to check out the whole picture. It's never in their jurisdiction!)
It takes a proper investigator like yourselves to find out the whole truth.
This is the connection:
'Anyone' of your 'Holiday Clubs' are almost certainly listed on this 'Timeshare Blacklist'.
Barclays Partner Finance IS PROBABLY A COVER NAME FOR Clydesdale Financial Services (Blacklisted)
HMC Funding is part of Barclays Partner Finance
Your money (from credit agreement) goes to Hutchinson & Co Trust Ltd, BARCLAYS BUSINESS CENTRE, Isle of Man (Hutchinson & Co Trust ltd are blacklisted).
Google GE (Finance) GIBRALTAR, they appear to have magically disappeared.
Screenbeach or any other company that might offer to buy your points are on this 'Timeshare' Blacklist.
St Francis ltd (or another company) who are on your VIP Purchase agreements who claim to be the retailers are also blacklisted. They never existed anyway.
Your 'HOLIDAY CLUB' will try and tell you that they are NOT the retailers but the "Marketers".
They are trying to pass the buck by claiming they didn't sell the product to you as they are the "Marketer".
They claim the responsibility for this product is with St FRANCIS the retailer or (maybe under another name) who don't exist!
(St Francis are blacklisted too!)
This is not true because your 'Holiday Club' sold you the product, they authorised all the credit arrangements and paperwork!
They are the TRUE RETAILERS!

The last line of the above post may be relevant but much of the rest is potentially misleading and may charitably be described as a rant.
There is no "official" blacklist, so why should any finance company pay attention to one? To do so could invite legal action as so many companies are on it, some for no good reason.
Plazz seems to suggest that timeshares are now sold as holiday club memberships to avoid legislation. This is of course untrue. Timeshares are timeshares and remain covered by the relevant legislation. Holiday clubs are not, but they are of course not timeshares.
Barclays Partner Finance is a recognised and known trade name of Clydesdale and is shown as such on the FSA database, so it is hardly a "cover".
St Frances Marketing Limited does exist and is a registered company. It is the company behind many of the "Devon" marketing operations - all of which should be avoided like the plague.
The "holiday club" probably didn't sell you the product. They are almost always sold by marketing agents, who get to keep most of the mone, relatively little of which actually reaches the holiday club company. If finance is involved then they will have arranged it. If you want to cancel and recover money you need to go for the people who sold you it in the first place.
Hutchinson are by no means relevant to many of the problem companies, most of which will never have heard of Hutchinsons and it is certainly not true to say that "your money goes to Hutchinsons" as if this were fact. It ain't.
I can see no evidence that HMC Funding (Home Mortgage Corporation) is part of Barclay Partner Finance in fact I am sure that it is not because BPF is only a trading name in any event.
Your CREDIT agreement would most certainly NOT contain the phrase "'This agreement is a timeshare agreement for the purpose of the Timeshare Act 1992.'" because it is a CREDIT AGREEMENT.

Hi Fred,
Thanks for your information.
We were actually scammed at the weekend so have the relevant documents in front of us as we type!
Of course there may not be such a thing as an 'official' Timeshare Blacklist. Who knows for sure?
However, EVERY party involved with my VIP Purchase Agreement are mentioned on this 'list'!
This includes; Buena Viva , Hutchinson & Co,St Frances and Petchey Leisure!
Is this a coincidence that they are on this 'Timeshare Blacklist' - which keeps on disappearing from the web?
On the Credit Agreement it says that BUENA VIVA are the "RETAILER" and on the VIP Purchase Agreement it says they are the "MARKETERS" for St Frances!
(Important documents were missing with my VIP Purchase Club agreement.)
It was Buena Viva that actioned the online Credit Agreement and the associated paperwork on the day!
They said they worked for Buena Viva there was no mention of St Frances.
We have been given the run around by Barclays Partner Finance (who were once Clydesdale Financial Services) when we've tried to cancel the agreement.
We have our Credit Agreement in front of us and this was 'switched' and obviously doctored.
Can you please explain this to me?
The top, right hand corner has been black marked out.
It says at the top of my credit agreement that it is a Barclays Partner Finance CREDIT CARD AGREEMENT.
(If this was the case why didn't we receive the T&Cs and cancellation notice?
The credit agreement also says that it is a credit agreement regulated by the Consumer Credit Act 1974.
AND IT CLEARLY STATES THAT "THIS AGREEMENT IS A TIMESHARE AGREEMENT FOR THE PURPOSES OF THE TIMESHARE ACT 1992"
I was told by the CAB that HMC are a debt collection company used by Barclays Partner Finance / Clydesdale Financial Services.
How can it say all these things if it is legitimate?
I am very happy to email you a copy of this if you want it!
As for 'RANTING' - It is up to the others that have been scammed to decide this.
They will need to look at their OWN agreements.
You need to ask why these 'Holiday Clubs' are getting away with this and not being stopped!
People and the authorities are not looking at the bigger picture!
Thanks for your information.

I don't need to ask why they have not been stopped. I have been posting on here for years and I do know most of the facts.
You referred to "HMC Funding". This does not sound like a debt collector. It is in fact this www.hmc-funding.co.uk/
Buena Viva is a trading name of St Frances and is therefore a part of it. Anything that BV says or writes is said or written by St Frances.
I assure you that the blacklist that you refer to is "private enterprise" and that there is no "official" list. It depends solely on the opinion of the anonymous individual who compiles it, has been accumulating names for so long that almost everyone is on it and was probably copied from the Cr*meshare original in any case. Some should not be on it. All the ones that you mention should be. It is irrelevant anyway.
I am amazed that any finance agreement (not the sale agreement) should say that it is regulated by timeshare legislation because finance agreements are not so regulated, and if you bought into a holiday club then any mention of timeshare is pointless. If it IS there as part of the contract you could be able to take advantage of timeshare legislation, and the failure to provide you with your rights under timeshare legislation (such as failure to advise you of the mandatory cooling-off period - which does not apply to holiday clubs or points), to get out.
You will be givewn the runaround by Barclays if they think that they can get away with it. Try pointing out to them that St Frances, who clearly issued the card agreement as their agent, failed to provide you (again as their agent) with the T&Cs and cancellation options. Remind them that St Frances arranged the finance by these means and that St F are not so far as one can tell authorised by anyone to act as a financial intermediary.

In an earlier post it was mentioned that Travelexe was not registered as a company with Companies House and that the only Travelexe Limited has a registered office in Wimpole Street, London
We were informed by Travelexe that an accountancy company called 'Sochalls' deal with all of their banking and finances and that they also manage the trust fund for 'Cashback europe'
On checking the Sochalls website it would appear that their address is
9 Wimpole Street
London W1G 9SR

Travelexe Limited is of course registered at Companies House. It was incorporated on 4th September 2007 and has the company number 06361129. The R/O is 9, Wimpole Street. This is not its trading address.
It is interesting that a travel company in Exmouth uses Sochalls.
You still won't get 100% back through any cashback scheme unless you own it. No way.

Hi Fred 2.
It was mentioned that HMC Funding are debt collectors used by Barclays Partner Finance / Clydesdale Financial Services.
This was mentioned by the CAB (who offer debt advice).
Fred try going onto: www.timesharesuppliers.com/hmc.funding/
This link takes you to the 'Timeshare suppliers guide'.
HMC seem to be the only organisation out of all of these names that are listed on the 'unofficial / official' Timeshare blacklist that CAN sell TIMESHARE.
You can also link back to the website YOU used from this.
You cannot link to the 'Timeshare suppliers guide' from YOUR route!
The website you used www.hmc.funding.co.uk/ does show the information that you say.
