Threat of being Sued advice please urgently

To outline current situation, we have been contacted by Daniels Silverman, commercial debt recovery and investigations and been told that unless we make back payments for to Elite Holidays for annual fees, we will be sued. They plan to take us to Court in Liverpool and have sent a letter saying someone is coming out on the 17th Aug to discuss this matter as we have failed to make payments.

We have not paid annual fees for this holiday scam because the contract we entered into has not been upheld from sellers Carpe Diem Resort, who were "official sales agents for Elite Holidays.

When we agreed to enter into this agreement (fools I know), as part of this agreement Carpe Diem Resort agreed to take over my timeshare in Florida, whereby they would become the owners, cover maintenance fees, etc. To date not only have Carpe Diem failed to take over this timeshare, cover maintenance fees but they have failed to respond to any letters I have sent regarding this matter. We have sent various letters over the last 4 years to Carpe Diem and Elite Holidays outlining our concerns, facts etc. To date no one has ever responded to our letters., including recent letters to Elite Holidays.


Has anyone been in a similar position, can you advice me please, do i need a solictor - who?

Just had a baby and the stress of this is getting me down.

any help advice appreciated

You certainly need to acquaint yourselves with the rules regarding debt recovery.

They cannot behave as they like, and this includes visiting you. Make sure they are aware the debt is in dispute.

And on another thread it advises that you ignore them until you get a summons. I am inclined to agree.

Silverman's are bluffers.
